2124. Deputy Roderic O'Gorman asked the Minister for Justice, Home Affairs and Migration for a detailed update in relation to the health diversion scheme for persons in possession of drugs for personal use; and if he will make a statement on the matter. [26008/26]
Minister for Justice, Home Affairs and Migration: My Department recognises that possession of illicit drugs for personal use must necessarily be viewed as a public health issue, and not just as a matter for the criminal justice system. Additionally, while punishment for those who commit crime is a central element of our justice system, the rehabilitation and reintegration of offenders is at the core of our penal system. For these reasons, my Department is taking an active role in responding to the Citizens’ Assembly on Drug Use recommendation that the State introduce 'a comprehensive health-led response to possession of drugs for personal use'.
The objective of the scheme is to provide an alternative pathway for individuals found in possession of illicit drugs for personal use, by facilitating An Garda Síochána in referring such individuals to appropriate health services. This approach is intended to support early intervention, treatment and recovery in cases where problematic drug use is identified.
Under the scheme, drug possession will remain illegal. However, where a person is found in possession of drugs for personal use, they will be afforded the opportunity to engage voluntarily with health services rather than face a criminal prosecution. This reflects the Government’s intention to prioritise a health based response while maintaining the existing legal framework.
The Minister of State with responsibility for the National Drugs Strategy and I have agreed that the scheme will commence on an administrative basis. An Garda Síochána and the Office of the Director of Public Prosecutions are currently finalising the operational arrangements required for national implementation. This work is well advanced, and it is expected that the scheme will commence shortly.
Once final sign-off is secured, the scheme will be rolled out at national level. It is intended that the operation of the scheme will be reviewed after 12 months to ensure it is meeting its aims and to make any necessary changes. A comprehensive process evaluation framework has been developed to undertake this review.
