In June 2023, the European Commission opened a consultation  on the safety of Cannabidiol (CBD) used in cosmetic products within the framework of Regulation (EC) 1223/2009.

The European Commission intends to request the EU Scientific Committee on Consumer Safety (SCCS) perform a safety assessment on CBD in the following forms:

In its pure form when used in cosmetic products. As an extract that may contain contaminants of other cannabinoids, such as THC* (Tetrahydrocannabinol) in trace amounts. As part of this assessment the Commission is issuing a call for data on the safety of CBD.  The cosmetics industry is invited to submit any data to the Commission that is relevant to this ingredient and the safety assessment.

*Cosmetic products on the Irish market must not contain any substances controlled under the Irish Misuse of Drugs Act 1977. If a cosmetic product contains quantities of a controlled drug, such as THC, it is illegal to import, export, possess or supply it to the Irish market. It is important to be aware that this is guidance we are providing with respect to the Misuse of Drugs legislation in Ireland. The Department of Health is responsible for this legislation and its related policies. The enforcement agencies for the Misuse of Drugs legislative framework are the Revenue Commissioners and An Garda Síochána. This does not purport to be an interpretation of law and/or regulations.
