The focus of this article is on the potential divergence between the welfare interests and due process rights of the juvenile in the Programme. The second section of the article will briefly outline the provisions of the Programme. This will be followed by an examination of the need for a customised rights approach in the Programme instead of the due process rights framework utilised by the traditional adversarial system.
